    Ok here we go.....

Can you believe this?? I rang consumer affairs, and aparently because our stuipid salesman did not put a specified delivery date on the contract, they were not in breech of contract by providing us with a green car rather than a grey one, because they could legally still order the grey one and have us wait another 5 months for it too come in & still be within the law. And if we were to cancel the contract that we would actually have to pay the dealer 5% of the full purchase price of the car.

OH MY GOD UNBELIEVABLE. So tip for everyone out there to make sure there is a delivery date on their contract (how stuipid were we to accept ours without).

When I spoke to the dealer, he didn't mention any of this.. to be honest I don't think that they realised that they had the upper hand. They did offer our money back, or to wait for another car. But neither thing helps us out much cause we need the car now... and just want the whole ordeal to be over.

Asked what kind of compensation they would give if we took the green one. He offered some pretty average things (mats , protectors etc) that people would normally be thrown in. - but because we had already screwed them so much on price hadn't put in.

He was playing pretty hard, till the missus arrived and went ballistic about the whole thing...long story short we are going to take the car & they are currently fitting out the GREEN MACHINE with.

    • WINDOW TINT PRIVACY GLASS.
    • HEADLIGHT & BONNET PROTECTORS
    • AERO ROOF RAILS – 3 BAR SET
    • COLOUR CODE OF WHEEL COVER PROVIDED BY US
    • FULL TANK OF FUEL
    • RUBBER CARGO MAT
    • SLIMLINE PLATES

Not a lot considering but we are ok with it all now, just so dissapointed. But we just want to get the car and get on with things. It actually - thank god- doesn't look as bad as it does on the toyota web site. Still no where near as good as any of the other colours though... esp grey or white. But can't really be stuffed worrying about it.

Will post a picture of the Green beast when we get it and you will all have to tell me how it looks great... even if you have to wack on a pair of stevie wonder specs!!

On a brighter note, our trackabout offroad camper arrived this week and it is the best thing ever, couldn't be happier with it. Just need to get the Prado so we can take it on the maiden vouage! (another reason for settling for the greeny, don't want to let summer pass with no 4x4).

Thanks all for your advice & kind words

Have a great weekend. Will post the pictures next week (remember...looks great mate!!).

Rod, I'm sure you'll be more than happy with the Green Machine, and I guess you'll learn to love the colour too, as it will be unique to you guys. Enjoy the great outdoors as soon as you take delivery... and hey, if you ever need to hide while in the bush, you're adequately camoflaged, and who knows, the military might want to take it off your hands a few years down the track. Think positive

        Hey Rod

You've made the best out of a pretty crappy situation - and come out in front.

Down the track, when you find yourself looking at the car and the issue of colour pops into your head, don't dwell on it and think of it as a hassle - think of it as a funny story to tell others - as you all sit by the BBQ, half a dozen camper trailers parked neaby, and your pride and joy hooked up to one of them ...

... as your new Prado takes you to all of the places you always wanted to go.
Enjoy the hell out of it.

        Cheers
        Chippy

sometimes how we envisage things, and how they really turn out is two different things. Most of my home projects are like that.
Hope you adore your Prado, for what it is, even if it is not your first choice colour.
Prado's are a really nice car to be involved with - even green ones.

            RJH,
At least the wait is nearly over.

As I said before I don,t mind the green, possibly because I once had a love affair with a green Range Rover.
            All the best,
            Fazza.

                RJH,

Sounds like a reasonably good outcome aftert all.

Put some dark tint on the green machine and she should look sweet!!!

Maybe paint the new trailer green aswell?

I recommend you read through your terms and conditions with a fine tooth comb. Mine has the following (Lifted from an earlier post).

                  Section 4.1
The dealer will deliver the vehicle to the purchaser on or before the delivery date stated in this contract.

                  Section 4.2
In the case of a new vehicle, if a delivery date is not stated in this contract, the dealer will deliver the vehicle within three (3) months of this contract becoming binding on the parties.

So It follows that if you don't recieve anything within 3 months then section 7 [Purchaser's right to terminate contract] is interesting too.
                  Section 7.1
The purchaser may terminate this contract if the dealer has breached any of the obligations imposed on the dealer by this contract.

Section 7.2 says that if you validly terminate the contract you should get your deposit back.

Seems you've made your peace with the situation though. I applaud you for that. If that was me, I'd be making sure that dealer went through 7 levels of hell and then some before I let them off the hook.

Found the following Pic. Not sure if that's the right green though.

I just saw a new Greenie and it is actually quite nice in the flesh. A nice dark colour. It may not be the colour you wanted but the missus and I both commented on how nice it looked. I don't think it's much to worry about mate. The dark tint made it look nicer too.

Still trying to stop pissing myself laughing at the kermit & shrek pictures!! Nice work on that.

Yeah that is the right colour (the prado picture not the cartoons!!). Yeah it does look pretty good with the dark tint... that is why we asked them to do the darkest tint they can on front & privacy glass at back. & with the roof rails & green hard wheel cover, should look pretty good.

Getting used to it all now. And starting to get excited about picking it up next week. We have decided to " EMBRACE THE GREEN ".

At the end of the day we've got our dream car, albeit a different colour than expected & are totally stoked about it... just can't wait for next week!!

                              Gidday Rod,

I must admit that I quite like the green. In fact my 90 series was green, and although that proved to be a problem with showing up scratches and things, it always looked really nice when polished up, and in particular with the tinted windows. I almost ordered my current one in green as I wanted to be a bit different to everyone else, but because of the climate up here I ended up going for silver. I am sure you will grow to love it regardless of the colour.

I still don't like the outcome... but if you turn vehicles over every few years (not me) then it might not hurt as much.
