    Howdy,

    I paid the $2,000 to extend my capped price servicing ($210) up until 170,000kms when I bought my 150 Prado GLX from an AHG Toyota dealership.

    I had my 10,000km service done at the same dealership, but I had my 20,000km service done at a non AHG Toyota dealership.

    AHG are now saying that I have voided my warranty, lost the $2k I initially spent and my capped servicing only last until the new car warranty runs out.

    Fuming!!

    Does this sound legit?

    Depends what you signed up for. Unfortunately it's all in the fine print.

      There are overarching laws though I thought?

      I know that you can get your car serviced where ever you like without voiding the new car warranty.

      Surely the same applies.

        Without voiding the new car warranty, yes. But not the extended warranty if it is had been specified in the policy documents that you must only service the car at that dealership. Lots of stories on the internet of dealerships doing this sort of thing and misleading people. They don't tell you upfront about the conditions but they just tell you the most attractive part.

        Have you got a good lawyer? Or ring consumer affairs for some advice?

          Its all a gamble.
          I didn't get the extended warranty. Now at 7 yrs old and 150,000, with no issues, I'm glad I didn't waste the $2,000

            If you weren't expressly informed of this obligation up front it doesn't matter what's in the fine print. It amounts to misleading and deceptive conduct on behalf of the stealer erm.. dealer. The MTA and ACCC frown upon that sort of caper. Explore your options through them.

              I got an email from the dealer saying were offering extended warranty from 3 to 6 years for $1299. Also extends the capped service fee (which I think is less than the current $210) but they made it clear that they (the dealer were offering it) not Toyota and I believe a condition is that you must service it with them all the time. My brother in law bought a Hilux 2 yrs ago (from a different dealer) and they told him if he got it serviced there all the time, they would extend the capped service for another 3 years at no cost. They seem to have the power to do their own deals it seems. As someone said, its in the fine print.

                Just checked the info they sent me, it says "this is a contract between you and Camberwell Toyota". And services drop to $199.

                  unfortunately it is legit, and it will be in the fine print. I have also dealt with AHG in another suburb, purchased my VX from there and the last time I saw them was in the rear vision mirror when I drove out. They attempted to sell me their 'extended warranty" without expressly informing of this obligation up front. They would not sell me the "Toyota extended warranty" even when I asked them directly. I had to contact Toyota to purchase the extended warranty myself. Glad I did, saved myself an extra $400. I will never go back, purchase or service any of my cars at their dealerships.

                  Your best and possibly only option to try get your money back is to raise it with fair trading, (or VCAT) explain that they had not expressly pointed out that you were required to have your car serviced specifically at their dealership.

                  For the cost of a local call you might get your money back, $2k is worth chasing.

                  From my dealings, I would not recommend anyone to have their car serviced or take out their "extended warranty" from a AHG dealership.

                    The general rule of contract is that your bound by what you sign (even if you didn't read it), terms can be expressed in the contract such as what is actually written in the document and has been agreed to orally. Terms can also be implied into the contract, things like past dealings, custom or trade usage, and other terms necessary to efficiently do business can be implied into the contract.

                    Here it seems that they promised you capped price servicing in return for you promising them exclusive servicing rights to your vehicle, by servicing with someone else you have broken that promise and probably breached the contract. If like someone has pointed out, a misrepresentation has occurred under section 18 of Australian Consumer Law then a range of remedies are available including avoidance or recession of the contract.

                    In order to establish misrepresentation you would need to establish that AHG made a representation to you, which was a statement of fact, the statement was false, it intended to induce you into the contract and you have actually acted on that inducement. I suggest that as a starting point you look at the term that binds you to exclusive servicing with AHG and determine if it is indeed wide enough cover your service with another Toyota dealer.

                      Thanks for the respone(s). I've spoken with my dealership and they have come good. They've said that it wasn't made clear to me that I had to get it serviced at an AHG dealership and they will honour the warranty.

                        Arguably The only warranty maybe worth having is the toyota warranty.
                        Warrantys that need the vehicle serviced by them or only certified places are b.s

                        Capped price servicing is ok if your on a tight budget & happy for any dude to work on your vehicle. It's not TOYOTA the manufacturer.
                        I'm told if you miss a service, you loose your capped price servicing?
                        What a load of crap, you send a lot of money purchasing your vehicle, you should find the best technician for the job, someone you trust & as long as the price is fair & reasonable that what you need.

                        The 150's I look after might cost them a little more over the time, but you get what you pay for.

                            DigginIt just to check, I also bought my Prado from Big Rock Toyota and got the extended warranty (I'm weak and it sounded good haha).

                            If I don't get it serviced at an AHG dealer for EVERY service I lose my extended warranty?

                            I was under the impression that I could get it serviced at any Toyota dealership whilst it was under new car warranty and then only AHG dealerships after the new car warranty ran out. If that isn't the case I will be ticked off as I moved to Bunbury and the only AHG dealership is a truck workshop.

                            Will have to call Big Rock as the 20 000 service is overdue.....

                              The Toyota factory capped price servicing can be overdue by upto 5000 km or 3 months before being voided.
